Why Is Title Holding Up the Sale of My Inherited House?
How we helped Beth sell her late father’s home in Independence, MO through probate, from several states away, to a cash buyer

What Happens When Probate and Title Don’t Line Up?
The Full Story
Beth lived several states away when her father passed and left her his home in Victorian Estates in Independence, Missouri. He had no beneficiary deed and no trust, so the house had to go through probate before anyone could sell it. By the time Beth found Nelson Home Group, Keller Williams KC North online, she had already hired a probate attorney. When she was in town she stayed at the house, painting and handling touch-ups.
Beth interviewed more than one agent, and one of them quoted a noticeably higher list price. Joe Nelson walked her through the actual comparable sales, recommended a lower range and explained why. Beth hired our team at that first meeting.
Then probate ran longer than she expected. It added cost and months of waiting, and the house sat empty the whole time she was home in another state. Beth’s goal never changed: sell the house cleanly and stop being responsible for a property she could not look after from that far away.
“Probate attorneys and title companies both want the sale to close. They just need different paperwork to get there, and somebody has to keep them talking.”
The Strategy
Joe Nelson of Nelson Home Group, Keller Williams KC North handled the sale. The work came down to three things: staying ready through the wait, pricing from the data and adjusting to the market, and keeping the attorney, the title company and Beth talking.
Staying ready through the wait. We kept in touch with Beth through months of probate while she chipped away at the house. When the estate had the authority to sell, the listing went live on September 25, 2025.

Pricing from the data, then adjusting. Beth chose the top of the range we recommended. Showings brought feedback about work the house still needed, the sloped driveway and the backyard rock wall, and the listing sat. Paying to carry an empty house she could not check on was costing her more than a price adjustment would, so we recommended getting aggressive. Beth agreed, and we made two reductions.
Keeping the attorney, the title company and the seller talking. What a probate attorney needs to satisfy the court and what a title company needs to insure a sale are not always the same. Communication between Beth and her attorney was not always clear, so our team translated, chased documents and kept everyone moving. When title raised an issue the estate’s attorney had to resolve before closing, Joe connected the title company directly with the attorney so they could settle what title needed to close.
“Beth was paying to keep up an empty house she couldn’t check on. A price that got it sold was cheaper than waiting.”
The Success
A cash buyer went under contract 46 days after the home listed, and the sale closed 23 days later, on December 3, 2025. That is 69 days from listing to closing. Beth paid no buyer concessions and made no repairs.
It took longer than Beth or our team expected, and the house sold after two price reductions and under its final list price. Beth accepted those tradeoffs for the outcome that mattered to her: the estate’s house sold for cash, and she was no longer responsible for a property she could not maintain from another state.
The takeaway for anyone holding an inherited house: bring the title company in early, alongside your probate attorney, and price for the condition the house is actually in. Every estate is different and probate timelines vary, so one sale is not a promise of how another will go. If you own a home now, a beneficiary deed or a trust can keep your family out of probate entirely; our team explains how in Protect Your Family From Probate. Nelson Home Group is not a law firm, so talk with a Missouri probate attorney and your title company about your own situation.

Frequently Asked Questions
Why does the title company need more than my probate attorney’s paperwork?
The probate attorney’s job is to satisfy the court. The title company’s job is to insure the buyer’s ownership, and its underwriter can require documents the court process does not automatically produce. On Beth’s sale in Independence, Missouri, title raised an issue the estate’s attorney had to resolve before closing. Getting the title company and the attorney talking directly is what cleared it. Talk with your own probate attorney and title company about your estate.
Should I lower the price on an inherited house that isn’t selling?
Look at what the showing feedback actually says and what waiting costs you. Beth’s listing sat while buyers pointed to a sloped driveway, the backyard rock wall and work the house still needed, and carrying an empty house from several states away cost her more than a reduction would. After two reductions, a cash buyer went under contract. It does not always go that way: when buyers in a Leavenworth probate sale only flagged exterior paint, our team held the price. And when a damaged inherited house in the Northland was priced to draw investors from day one, it sold in 4 days.
How long did this inherited house take to sell once probate allowed it?
The estate waited several months in probate before the house could be listed. Once it listed on September 25, 2025, it went under contract with a cash buyer 46 days later, on November 10, and closed 23 days after that, on December 3, 2025. That is 69 days from listing to closing.
